There has been a significant growth in the supply Personal Injury jobs in the marketplace over the last 10 years which has led in turn to Personal Injury jobs being an attractive career option for many solicitors.


Personal Injury jobs will tend to specialise in working for either claimants or defendants. Examples of the larger claimant practices would be Shoosmiths, Irwin Mitchell and Lyons Davidson. Examples of those in the Defendant field would be Beachcrofts, Greenwoods and Berrymans Lace and Mawer.


Claimants will usually be individuals and defendants can vary from members of the public to multinationals.


Personal Injury law falls into the catchall Civil Litigation area and knowledge of Civil Procedure, as well as the substantive law involved in a case, is required.


Investigating claims in detail at the outset is of crucial importance, for both claimant and defendant lawyers.


For claimants, public funding is only available for a few types of claim. Most claimants will look to their lawyer to take cases on a “no win, no fee” basis. Clearly the claimant lawyer will not want to take on weak cases, nor pass up strong ones.


Personal Injury jobs involve handling a very high number of cases and working under pressure and to deadlines are every day part of a Personal Injury lawyer’s life.


The Personal Injury marketplace has become very specialist in certain areas. A generalist will tend to have a range of cases resulting from road traffic accidents (RTA), accidents at work (Employers Liability) and general slips and trips.


However there are a number of areas which have splintered off from general the general Personal Injury job including Industrial Disease, Clinical Negligence which are specialist fields now in their own right.


In recent years with the advent of claims companies and further mass marketing, there are fewer Personal Injury jobs being done by the smaller high street legal practices. This is especially true of the smaller value small and fast track cases. Larger practices are able to take a higher volume of Personal Injury jobs on by employing more Paralegals (as they cost less) than trained Solicitors.


For a solicitor, the longer term job/career options as a technician will be more focused on progressing towards working on higher value claims such as catastrophic and serious injury work. This work will be better paid and intellectually more demanding. An alternative career path to this could be moving towards management as a team leader, where your legal job would involve managing a team of Paralegals, Legal Executives and junior Solicitors.


Personal Injury claims generally result in damages and costs being awarded. Defendant solicitors are keen to ascertain the risks of a case as early as possible and to gauge whether to settle or fight the claims further.


The reasons that lead up to an injury are varied and diverse and the investigative procedure can be interesting and in some cases amazing. The pressure to represent you client within tight time constraints can make this a challenging yet rewarding area of the law.


As a footnote the proliferation of fraudulent claims has led to a new specialism of defendant Personal Injury legal jobs too, which larger defendant legal practices such as Keoghs are leading the way.
